2. These terms
These terms apply to every order placed on www.liquidmetalfx.com. Please read them before ordering. Some sections apply only to consumers (people buying for personal use, not for a business). Others apply only to trade customers (anyone buying for their business, trade or profession). If you are a trade customer, tell us at checkout or by email.
3. Products
- We sell liquid metal coatings, metal powders, binders, patinas, kits, microcement and related products.
- Colours and finishes on screen are a guide only. Results depend on surface, preparation, application and conditions.
- Some products are hazardous chemicals. Read the label and the Safety Data Sheet (SDS) before use. SDS are available at liquidmetalfx.com/sds or on request.
- Follow our application guidance. We are not responsible for results where products are mixed, stored or applied outside our instructions.
4. Prices and payment
- Prices are in pounds sterling (GBP). VAT is added at checkout at the current rate.
- Delivery charges are shown at checkout. See our Delivery Policy.
- Payment is taken at checkout through Wix Payments and the other payment options shown at checkout (for example debit and credit cards, Apple Pay, PayPal and Klarna).
- If we list a product at an obviously wrong price, we may cancel the order and refund you in full.
5. Your order and our contract
- Your order is an offer to buy. The contract is formed when we email you to confirm dispatch [or: confirm acceptance].
- We may refuse an order, for example if stock is unavailable or a product cannot be shipped to your address. If so, we refund you in full.
6. Delivery
See the Delivery Policy. Risk in the goods passes to you on delivery. Ownership passes to you once we receive full payment.
7. Consumers: your right to cancel (Consumer Contracts Regulations 2013)
- You can cancel your order within 14 days of the day you (or someone you name) receive the goods. You do not need to give a reason.
- To cancel, email liquidmetalfx@gmail.com with your order number. You can use the model cancellation form below, but you do not have to.
- Return the goods within 14 days of telling us you are cancelling. You pay the return postage, unless the goods are faulty or wrong.
- We refund the price and standard delivery cost within 14 days of receiving the goods back (or proof of return). We may reduce the refund if the goods have been handled more than needed to check them.
Exceptions — the right to cancel does not apply to:
- goods made or mixed to your specification (for example custom-mixed colours or bespoke kits);
- sealed goods that are unsuitable for return for health, hygiene or safety reasons once unsealed (for example opened chemicals, binders or patinas);
- goods that, after delivery, have been inseparably mixed with other items;
- goods that deteriorate or expire rapidly.
[Owner decision: confirm which products fall within each exception and list them.]
Model cancellation form: "To Liquid Metal FX, Unit 10H, Mostyn Road Business Park, Mostyn Road, Holywell, CH8 9DP, liquidmetalfx@gmail.com. I hereby give notice that I cancel my contract of sale of the following goods: [ ]. Ordered on [ ] / received on [ ]. Name: [ ]. Address: [ ]. Signature (if on paper): [ ]. Date: [ ]."
8. Consumers: faulty goods (Consumer Rights Act 2015)
Goods must be as described, fit for purpose and of satisfactory quality. If they are not:
- within 30 days of delivery you can reject them for a full refund;
- after 30 days (up to 6 months) you can ask for a repair or replacement, and then a refund or price reduction if that fails;
- these rights last up to 6 years in some cases.
Nothing in these terms affects your statutory rights. For more information, contact Citizens Advice.
9. Trade customers
If you buy as a trade customer:
- The 14-day cancellation right in section 7 does not apply. Returns are at our discretion. We do not charge a restocking fee.
- Report damage or shortages within 7 days of delivery.
- We warrant that goods match their description and specification at delivery. All other warranties and conditions are excluded as far as the law allows.
- You are responsible for testing products on your substrate before full application, and for site safety, preparation and workmanship.
- Our total liability for any order is limited to the price paid for that order. We are not liable for loss of profit, business, contracts or labour costs, or for indirect loss.
- [Owner decision: trade credit accounts and payment terms, e.g. [TRADE PAYMENT TERMS].]
10. Our liability (all customers)
- We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law.
- For consumers, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms. We are not responsible for business losses.
- We are not responsible for results caused by surface preparation, application method, mixing, storage or use contrary to our instructions or the SDS.
11. Events outside our control
We are not liable for delays caused by events outside our reasonable control. We will tell you and, if the delay is long, you may cancel for a refund.
12. Complaints
Email liquidmetalfx@gmail.com. We aim to reply within 1–2 working days.
13. Law
These terms are governed by the law of England and Wales. Consumers may bring claims in the courts of the part of the UK where they live. Trade customers agree to the exclusive jurisdiction of the courts of England and Wales.
